Its main purpose is to <\/span><b>prove the existence of a transport contract<\/b><span style=\"font-weight: 400;\"> and record the essential details of the shipment, so that the authorities can verify <\/span><b>on the road<\/b><span style=\"font-weight: 400;\"> that the service complies with current regulations. <\/span><b>In other words, the DCA guarantees the legality and traceability of each shipment<\/b><span style=\"font-weight: 400;\">, preventing unlawful operations (unauthorized or \u201coff-the-books\u201d transport) and facilitating inspections or procedures in the event of incidents.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The <\/span><b>mandatory nature<\/b><span style=\"font-weight: 400;\"> of the DCA is established by Spanish transport legislation (LOTT and related regulations). Specifically, <\/span><i><span style=\"font-weight: 400;\">Order FOM\/2861\/2012<\/span><\/i><span style=\"font-weight: 400;\"> regulates the requirement to document every shipment by means of a <a href=\"https:\/\/www.boe.es\/buscar\/doc.php?id=BOE-A-2013-154#:~:text=,%C3%A1mbito%20de%20aplicaci%C3%B3n\" target=\"_blank\" rel=\"noopener\">DCA<\/a>. This document <\/span><b>must be carried on board the vehicle<\/b><span style=\"font-weight: 400;\"> together with the goods throughout the entire journey. There are some <\/span><b>very specific exceptions<\/b><span style=\"font-weight: 400;\"> (for example, removals, local small-parcel deliveries, transport on own account or free of charge, etc.), but in general <\/span><b>every professional transport operation needs its DCA<\/b><span style=\"font-weight: 400;\">. It should be noted that <\/span><b>the DCA is administrative in nature<\/b><span style=\"font-weight: 400;\">, distinct from the private contract, and serves as an <\/span><b>instrument of control for the Administration<\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><b>How is the DCA different from the consignment note?<\/b><span style=\"font-weight: 400;\"> The consignment note is the document that formalizes the transport contract between shipper, carrier and consignee, whereas the DCA is an administrative control requirement. However, <\/span><b>the two can be combined<\/b><span style=\"font-weight: 400;\">: the consignment note itself (or another equivalent transport document) can serve as the DCA provided it includes <\/span><b>all the mandatory data<\/b><span style=\"font-weight: 400;\"> required by Order FOM\/2861\/2012. These minimum data include, among others: details of the contracting shipper and the actual carrier (name, NIF, address), origin and destination of the shipment, date of transport, description and weight of the goods, vehicle license plate, etc. In short, <\/span><b>the DCA has no single predefined format<\/b><span style=\"font-weight: 400;\"> \u2013 each company may design it as it sees fit \u2013 but it <\/span><b>does have mandatory minimum content<\/b><span style=\"font-weight: 400;\"> to ensure its legal validity.<\/span>[\/vc_column_text][vc_column_text css=&#8221;&#8221; text_direction=&#8221;default&#8221; el_id=&#8221;estado-normativa-dca-digital&#8221;]\n<h3>The current state of the regulation: towards a mandatory digital DCA<\/h3>\n<p><span style=\"font-weight: 400;\">The digitization of the DCA is already a legal reality on the way. Currently, <\/span><b>it is already legal to use the DCA in electronic format<\/b><span style=\"font-weight: 400;\">, provided that certain technical guarantees of readability, integrity, and inviolability of the document are met. In fact, the Ministry of Transport (MITMA) published a resolution on June 7, 2023 establishing the <\/span><b>technical conditions<\/b><span style=\"font-weight: 400;\"> to consider a <\/span><b>DCA in electronic form<\/b><span style=\"font-weight: 400;\"> valid. This regulation requires, for example, that the digital document can be transformed into a readable format (e.g., PDF) without altering its content, and that it incorporates mechanisms to ensure its authenticity (electronic signatures, systems that detect any subsequent modification, etc.).<\/span><\/p>\n<p><span style=\"font-weight: 400;\">That said, the major regulatory change comes with the new <\/span><b>Sustainable Mobility Law<\/b><span style=\"font-weight: 400;\"> (currently in its final approval stage). This law will include the <\/span><b>mandatory use of the electronic DCA<\/b><span style=\"font-weight: 400;\"> in the coming years, definitively ending the paper era. Initially, it was planned to require the <\/span><b>control document exclusively in electronic format as of September 1, 2024<\/b><span style=\"font-weight: 400;\">, but its entry into force has been <\/span><b>postponed<\/b><span style=\"font-weight: 400;\"> to give more <a href=\"https:\/\/atramgestion.com\/es\/b\/blog-transporte-terrestre\/radares-peajes-sanciones-y-controles\/p\/se-pospone-la-obligatoriedad-del-documento-de-control-electronico-273-6#:~:text=El%20Ministerio%20de%20Transportes%20ha,de%20control%20en%20formato%20electr%C3%B3nico\" target=\"_blank\" rel=\"noopener\">leeway to the sector<\/a>. According to the latest forecasts, <\/span><b>it will be at the beginning of 2026 when the digital DCA becomes mandatory<\/b><span style=\"font-weight: 400;\"> for most transport operations. This is set out in the transitional provision of the Sustainable Mobility Law, which postpones the initially proposed date by ~1.5 years due to the system\u2019s <\/span><b>technical complexity<\/b><span style=\"font-weight: 400;\"> and the need for <a href=\"https:\/\/www.autonomosyemprendedor.es\/articulo\/autonomos\/gobierno-retrasa-2026-obligaciones-digitales-autonomos-transporte\/20240321164751035288.html#:~:text=El%20Ministerio%20de%20Transportes%20y,p%C3%BAblico%20de%20personas%20por%20carretera%E2%80%9D\" target=\"_blank\" rel=\"noopener\">transport companies to adapt<\/a>.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Moreover, the rollout will be <\/span><b>gradual<\/b><span style=\"font-weight: 400;\">. The regulation (derived from R.D.-law 14\/2022 and the forthcoming regulatory development) establishes that <\/span><b>from 2026 all B2B goods shipments with a value greater than \u20ac150 must be documented with a digital consignment note\/DCA<\/b><span style=\"font-weight: 400;\">, and by 2027 the requirement will generally extend to practically <\/span><a href=\"https:\/\/oruslogistics.es\/en\/digital-consignment-note-everything-you-need-to-know-about-ecmr-in-spain\/#:~:text=%2A%20Real%20Decreto,pa%C3%ADses%20ya%20lo%20han%20ratificado\" target=\"_blank\" rel=\"noopener\"><b>all professional carriers with a commercial contract<\/b><\/a><span style=\"font-weight: 400;\">. In short, in 2026 the <\/span><b>e-DCA<\/b><span style=\"font-weight: 400;\"> will be the new rule for most operations (except small low-value shipments or other exemptions), and in 2027 it will already be the <\/span><b>universal standard<\/b><span style=\"font-weight: 400;\"> in road freight transport in Spain.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">To facilitate this transition, the European Union itself is also pushing in the same direction through the <\/span><b>eFTI Regulation<\/b><span style=\"font-weight: 400;\"> (Electronic Freight Transport Information), which entered into force in August 2024 and creates a framework for the mutual recognition of electronic transport documents at the European level. Spain, for its part, has already ratified the <\/span><b>eCMR Protocol<\/b><span style=\"font-weight: 400;\"> (electronic consignment note for international CMR), and with the new law it is fully aligned with documentation digitization.<\/span>[\/vc_column_text][vc_column_text css=&#8221;&#8221; text_direction=&#8221;default&#8221; el_id=&#8221;implicaciones-legales-operativas&#8221;]\n<h3>Legal and operational implications for transport and logistics companies<\/h3>\n<p><span style=\"font-weight: 400;\">For transport professionals, the arrival of the <\/span><b>mandatory digital DCA<\/b><span style=\"font-weight: 400;\"> entails several new <\/span><b>challenges and responsibilities<\/b><span style=\"font-weight: 400;\">. <\/span><b>Legally<\/b><span style=\"font-weight: 400;\">, from the established date (early 2026), <\/span><b>failure to have the DCA in electronic format when required will be sanctionable<\/b><span style=\"font-weight: 400;\"> with significant fines and even vehicle immobilization. Currently, the absence of\u2014or deficiencies in\u2014the control document are already considered serious infringements under transport regulations, with penalties ranging from approximately \u20ac401 to \u20ac1,000 depending on the case. With the electronic version, these penalties will equally apply if the document <\/span><b>has not been formalized digitally<\/b><span style=\"font-weight: 400;\"> when mandatory, if any essential data is missing, or if it cannot be shown to inspection officers. In short, <\/span><b>companies that do not implement the digital DCA in time risk roadside stops for their trucks, hefty fines, and operational impacts<\/b><span style=\"font-weight: 400;\"> due to regulatory non-compliance.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Operationally, transport and logistics companies will need to <\/span><b>adapt their internal processes and IT systems<\/b><span style=\"font-weight: 400;\">. Issuing the digital DCA will involve using <\/span><b>specialized software or platforms<\/b><span style=\"font-weight: 400;\"> to generate the document with the mandatory fields and a valid electronic signature. It will also require training staff (both administrative teams and drivers) in the use of these tools. For example, the <\/span><b>actual carrier (driver)<\/b><span style=\"font-weight: 400;\"> will remain responsible for carrying the document, but now <\/span><i><span style=\"font-weight: 400;\">in electronic form<\/span><\/i><span style=\"font-weight: 400;\">: they must have a means to display it during the journey (a smartphone, tablet, or device with access to the document). It is essential to ensure that <\/span><b>the driver knows how to access the digital DCA even without an internet connection<\/b><span style=\"font-weight: 400;\">, so it can be presented on the road during an inspection at any time.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Another important implication is the <\/span><b>coordination between shippers, logistics operators, and carriers<\/b><span style=\"font-weight: 400;\">. The regulation establishes that <\/span><b>all parties involved in the transport contract are responsible for formalizing the DCA<\/b><span style=\"font-weight: 400;\">\u2014that is, both the actual carrier and the contractual shipper must ensure that the shipment is <a href=\"https:\/\/www.boe.es\/buscar\/doc.php?id=BOE-A-2013-154#:~:text=Estar%C3%A1n%20obligados%20a%20la%20formalizaci%C3%B3n,del%20documento%20de%20control\" target=\"_blank\" rel=\"noopener\">properly documented<\/a>. In practice, this means that <\/span><b>shippers and logistics operators must also integrate with the digital systems<\/b><span style=\"font-weight: 400;\"> or platforms where the document is generated, so they can complete or verify the shipment data before departure. Agreements between shippers and carriers should be updated to define <\/span><b>who generates the electronic DCA<\/b><span style=\"font-weight: 400;\">, how it is shared and stored, and to ensure it always travels with the goods (even if only in digital form).<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Finally, there are <\/span><b>custody and audit<\/b><span style=\"font-weight: 400;\"> considerations: companies must retain control documents in digital format for the period set by law (currently at least 1 year, although keeping them longer is recommended) in order to handle potential delayed inspections or claims. Fortunately, digital solutions make this automatic archiving with backups easier\u2014something that was far more cumbersome on paper.<\/span>[\/vc_column_text][vc_column_text css=&#8221;&#8221; text_direction=&#8221;default&#8221; el_id=&#8221;dca-vs-cmr-ecmr&#8221;]\n<h3>DCA vs CMR\/eCMR: differences in domestic and international transport<\/h3>\n<p><span style=\"font-weight: 400;\">It is important to distinguish the scope of application of the DCA from other transport documents such as the <\/span><b>traditional consignment note<\/b><span style=\"font-weight: 400;\"> or the <\/span><b>international CMR<\/b><span style=\"font-weight: 400;\">. <\/span><b>In domestic transport (within Spain)<\/b><span style=\"font-weight: 400;\">, the DCA \u2013 or the consignment note acting in its place \u2013 is the mandatory control document under domestic regulations. By contrast, <\/span><b>in international road transport<\/b><span style=\"font-weight: 400;\"> between countries that are parties to the CMR Convention, the essential document is the <\/span><b>CMR<\/b><span style=\"font-weight: 400;\">, which formalizes the international carriage contract.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In short, for <\/span><b>domestic shipments<\/b><span style=\"font-weight: 400;\"> the <\/span><b>Administrative Control Document<\/b><span style=\"font-weight: 400;\"> (paper or digital) is required by Spanish legislation in order to circulate within national territory. For <\/span><b>international shipments<\/b><span style=\"font-weight: 400;\">, the <\/span><b>CMR<\/b><span style=\"font-weight: 400;\"> (Convention on the Contract for the International Carriage of Goods by Road, Geneva 1956) acts as the international consignment note and contains the details of the contract between the shipper and the carrier who will cross borders. Spain is a party to that convention, so a <\/span><b>valid CMR meets the documentary requirements<\/b><span style=\"font-weight: 400;\"> for international journeys. In fact, Spanish regulations recognize that if a transport operation is already documented with a CMR or another consignment note in accordance with international or EU law, <\/span><b>that document also serves as the DCA<\/b><span style=\"font-weight: 400;\"> provided it includes the mandatory data mentioned.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Now, a similar situation applies with digitalization: domestically we talk about a <\/span><b>digital DCA<\/b><span style=\"font-weight: 400;\"> or <\/span><b>\u201celectronic consignment note\u201d<\/b><span style=\"font-weight: 400;\">, while for international movements there is the <\/span><b>eCMR<\/b><span style=\"font-weight: 400;\">, which is the electronic version of the CMR. <\/span><b>Key differences?<\/b><span style=\"font-weight: 400;\"> In practice, <\/span><b>the eCMR serves the same function as the digital DCA in the international sphere<\/b><span style=\"font-weight: 400;\">, except that it must be accepted by both the country of origin and the country of destination. If Spain requires a digital DCA in 2026, that will mean a truck leaving Spain for another country must carry its documentation electronically; if the destination country also accepts eCMR (more than 30 countries have already ratified the eCMR protocol), then a <\/span><b>single electronic document<\/b><span style=\"font-weight: 400;\"> will serve both to comply with Spanish rules (DCA) and international rules (CMR). That is why the term <\/span><b>\u201cdigital consignment note\u201d<\/b><span style=\"font-weight: 400;\"> is often used generically, covering both the domestic digital DCA and the international eCMR, as applicable to each transport.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In summary, <\/span><b>for domestic transport<\/b><span style=\"font-weight: 400;\"> the control document (DCA) is mandatory under Spanish law, while <\/span><b>for international transport<\/b><span style=\"font-weight: 400;\"> the CMR (or eCMR if digital) is the primary contract document. With the new law, Spain requires that domestic shipments also be handled electronically, just as is already being done for international ones.
